Request Summary: 1- ESDC's Fitness to Work and Functional Abilities Assessment (FITFAA) evaluation policies & procedures, current versions, including changes to policies & procedures since COVID-19's impact in early 2020 to present day. 2- Number of FITFAA forms ESDC received or requested from January 1, 2020 to October 31, 2024, by year, where the doctor's medical recommendation was for the employee to work from home 5 days per week under the Duty to Accommodate (DTA). 3- Number FITFAA under item 2 above, by year, that were approved by ESDC based on the doctor's medical recommendations. 4- Number of FITFAA based on item 2 above, by year, that the Employer requested further functional limitations information. 5- FITFAA policy/evaluation procedures and DTA that apply when: Employee's doctor recommends in FITFAA that employee is to work from home 5 days a week. Employer requests more functional abilities from the employee's doctor, including the employee's ability to drive to the designated workplace and/or use public transportation to attend the designated workplace. 6- ESDC's evaluation policies & procedures related to FITFAA, requesting more medical and personal information than what is already disclosed on FITFAA form that the employer prepared for the doctor to respond to. When do more requests for medical and functional limitations become an invasion of privacy? 7- Should there be an invasion of Privacy as per item 6 above, what is an employee's entitlement and process for recourse?
