Request Summary: Pursuant to the Access to Information Act, I hereby request access to documents and records held by Immigration, Refugees and Citizenship Canada (IRCC) concerning the application of Section 34(1)(f) of the Immigration and Refugee Protection Act (IRPA) to individuals affiliated with the Islamic Revolutionary Guard Corps (IRGC) of Iran. This request follows the recent decision by the Minister of Public Safety to add the IRGC to the list of designated terrorist entities on June 19, 2024. Specifically, I am seeking documents, policies, guidelines, directives, and any other relevant records issued by IRCC that address or include the following: 1. Application of Section 34(1)(f) of IRPA: Any internal policies or guidelines on the interpretation and application of Section 34(1)(f) concerning membership in organizations designated as engaging in terrorism, subversion, or espionage. 2. Military Employees Employees Policies or guidelines on how IRCC assesses the admissibility of military personnel of the IRGC, including commanders and enlisted soldiers, under Section 34(1)(f). 3. Non-Military Employees Documents detailing the criteria and considerations used by IRCC to determine the admissibility of non-military employees of the IRGC who support the organization's operations in administrative, technical, or other non-combat roles. 4. Conscripted Soldiers: Any specific policies or guidelines regarding the treatment of conscripted soldiers who serve in the IRGC, particularly regarding their temporary and compulsory service and how it impacts their admissibility under Section 34(1)(f). 5. Relevant Case Studies or Precedents: Any case studies, precedents, or examples where Section 34(1)(f) has been applied to individuals affiliated with the IRGC, including detailed assessments and outcomes. 6. Training Materials: Training materials or manuals provided to IRCC officers related to identifying and assessing individuals associated with the IRGC under Section 34(1)(f). 7. Internal Memos and Communications: Internal memos, emails, or other communications within IRCC that discuss the application of Section 34(1)(f) to members of the IRGC, including any discussions on the differentiation between military, non-military, and conscripted personnel.
